İslam ceza hukukunda hukuka uygunluk nedeni olarak “Spor faaliyetleri”

Abstract

İslam dini, özelde bireye fiziksel güç ve maharet kazandıran, genelde ise topluma faydası dokunan her tür spor faaliyetine izin vermiştir. Hatta bu tür faaliyetlerin yeterli sayıda Müslüman fert tarafından gerçekleştirilmesini emretmektedir. İslam hukuku bilginleri, adam öldürme ve müessir fiil suçlarında faile yaptırım uygulamak için, suç genel teorisinde yer alan maddi unsuru yeterli görmemişler, bununla beraber hukuka uygunluk nedenlerinden birisinin bu lunup bulunmadığına dikkat etmişlerdir. Buna göre İslam hukukunda yasal kabul edilen ve hasma karşı şiddet kullanımının söz konusu olmadığı spor ak tivitelerinde cezai sorumluluğu kaldıran etken hukuka uygunluk nedenlerinden “hakkın kullanılması”dır. Rakibin bedenine yönelik darbelerle icra edilen dövüş sporlarında ise bu tür bir sorumluluğu kaldıran şey müsabaka öncesinde üstü kapalı şekilde alınan izin, yani “mağdurun rızası”dır.

Islam has allowed sports activities that give physical strength and skill to individuals and benefits to the society at large. Moreover, it orders them to be performed by a sufficient number of Muslim people. The scholars of Islamic law have not found the material element of the general theory of crime that preconditions to inflict punishment on the crimes of manslaughter and actual bodily harm adequate, yet they have also paid attention to whether there are other grounds of justification. One of the factors that removes the criminal responsibility of actual bodily harm when there is no use of violence against rival in sporting activities has been adopted legally by Islamic law, is called “the use of right”. However, the factor that removes this kind of responsibility in the combat sports, which is performed on the rival’s body, is due to a permission taken by the approval of the persons.
