The article aims to bring a political dimension to the problem of constituent power, which is usually discussed in terms of constitution techniques. It argues that some approaches reducing the problem of constituent power to the methodological pre-commitments or the articulations of abstract democratic principals presuppose de-ontological and apolitical premise. In other words, it focuses on the apologetic attitudes of these approaches isolating the modern content of constituent power if we consider its meaning as the creation of new political forms. In conclusion, the article points to the fact that any understanding of constituent power, which ignores its modern particularizy, may result in a poor understanding of democracy
