Fıkıh tarihi açısından Haydar Rıfat'ın Malumat-ı Kanuniye adlı eseri

Abstract

Çalışmamız, Osmanlının son dönemleri ile Cumhuriyet döneminde yaşamış olan Haydar Rıfat Yorulmaz'ın Yeni ve Mükemmel Malumat-ı Kanuniye adlı eserinin fıkıh tarihi açısından değerlendirilmesini ortaya koymayı hedeflemektedir. Avukatlık kimliğiyle üstlenmiş olduğu davalarda ön plana çıkan Haydar Rıfat Yorulmaz yazmış olduğu eserler ve çevirileriyle de ön plana çıkmıştır. Bu bağlamda, tezimizde Haydar Rıfat'ın hayatı, üstlendiği davalar, kişiliği ve kaleme almış olduğu eserleri incelenmiştir. Bununla birlikte incelemekte olduğumuz eserle ilgili bilgilendirmelere yer verilmiştir. Yazarın eseri oluştururken faydalanmış olduğu kaynaklar araştırılarak eserle karşılaştırılması yapılmıştır. Ayrıca Osmanlı Türkçesi ile yazılmış olan Malumat-ı Kanuniye adlı eser latinize edilerek çalışmamıza eklenmiştir. Bu eserle ilgili değerlendirmeler ve tespitler ise, tezin ilgili bölümlerinde ve sonuç bölümünde aktarılmaya çalışılmıştır.

Our study aims to reveal the evaluation of Haydar Rıfat Yorulmaz's named, Yeni ve Mükemmel Malumat-ı Kanuniye in terms of the history of fiqh, who lived in the last periods of the Ottoman Empire and the Republic period. Haydar Rıfat Yorulmaz, who came to the fore in the lawsuits he undertook as a lawyer, also came to the fore with his works and translations. In this context, Haydar Rıfat's life, the cases he has undertaken, his personality and his works have been examined in our thesis. In addition, information about the work we are examining is included. The sources used by the author while creating the work were searched and compared with the work. In addition, the work named Malumat-ı Kanuniye written in Ottoman Turkish has been added to our work in latinized. The evaluations and determinations about this work have been tried to be conveyed in the relevant parts of the thesis and in the conclusion part.
