Abstract The hot debate about 3rd Bosphorus Bridge that has planned since 1987 and started process of its building has gained new dimensions. Temporary Article 3 of the Environmental Impact Assessment (EIS) regulations doesn’t examine several investments that may destruct the ecology like 3rd Bosphorus Bridge, isn’t removed from regulations in spite of the decision to cancel of the judiciary. This article is out of scope for the investments and facilities that were built before 23rd of June 1997 by adding Temporary Article 3 to Law of Environment. The EIS, which is one of the apparatus of the sustainability that were discharged by the neoliberal saving process, has two sources of legitimacy. First it has the characteristics of a scientific report (ideological apparatus) and second it is legitimate. EIS as a scientific report is a research and an examination that reveals negative results and searches the social, economic, political, and psychological effects. In judiciary way, EIS is in the position of an apparatus which regulates capitalist relations of production and make them juridical. This study aims to explain main reasons of recent practical differences in environment management relevant to construction of 3rd Bosphorus Bridge through EIS. This study deals with what provided and promised after construction of 3rd Bosphorus Bridge, how provides neoliberal ideology reproduction. This study claims that, EIS is used to solve environmental problems which prevent the accumulation, in support of capital instead of to aim ecological sustainability in the present conditions.
